Chapter 15

AI Will Not Replace the Lawyer or Mediator: How Human Judgment and Smart Systems Are Reshaping Law

Human Judgment, Ethical AI, and the Future of Law and Conflict Resolution

In “AI Will Not Replace the Lawyer or Mediator: Human Judgment, Ethical AI, and the Future of Law and Conflict Resolution,” Megan G. Orlando explores how artificial intelligence is reshaping the legal and mediation fields without replacing the essential role of human judgment. The chapter offers a clear, grounded perspective on what AI can do well — organize information, support drafting, improve efficiency, and help professionals think through complex issues — while also explaining why it cannot replace wisdom, ethics, empathy, discretion, or professional responsibility. Drawing from her experience as a California attorney, mediator, trainer, and former court leader, Orlando emphasizes that AI is most useful when it remains a tool under human direction. Lawyers and mediators must continue to lead with discernment, confidentiality awareness, cultural sensitivity, and ethical judgment. The chapter encourages professionals to approach AI neither with fear nor blind enthusiasm, but with practical curiosity and clear boundaries. At its heart, this chapter is a call to keep humanity at the center of innovation. As smart systems become more common in law, mediation, and conflict resolution, Orlando reminds readers that the future will not belong to technology alone. It will belong to professionals who know how to combine intelligent tools with human presence, careful listening, ethical courage, and the wisdom to know when technology should assist — and when it should step aside.

Key Takeaways

  • AI can assist, but it should not decide.
  • Human judgment, empathy, and ethics remain central to law and mediation.
  • The best future is not human versus technology — it is human wisdom supported by responsible tools.

About Megan G. Orlando

Over the course of my career, I have represented parents and children, mediated complex multi-party child abuse cases, trained mediators throughout California, and presented at conferences on mediation, domestic violence, and developments in the law. I also served the Los Angeles Superior Court as Administrator of Dependency Mediation and later as Self-Help Supervising Attorney, where I helped expand access to justice, supported court-connected programs, trained staff and JusticeCorps fellows, and worked with self-represented litigants in family law matters. My work has always been grounded in deep listening, kindness, skilled advocacy, and a commitment to helping people feel heard and understood. Whether in the courtroom, in mediation, or in training environments, I value clarity, self-determination, and practical solutions. In this next chapter, I am focused on helping lawyers, mediators, paralegals, helping professionals, businesses, and individuals implement and use artificial intelligence safely, wisely, and effectively. I have developed courses and trainings that make AI accessible, practical, and ethically informed for both professional and personal use.
